Terms of Use
Sections 15 and 16 of Article III of these Terms contain an arbitration agreement and class action waiver that apply to all claims brought against Go Greatest, LLC. Please read them carefully.

Go Greatest connects local businesses with families seeking the greatest kid’s party experiences.
These Terms of Use (the “Terms” or “Agreement”) are a binding legal agreement between you and Go Greatest LLC, a Delaware limited liability company (“we,” “us,” “our,” or the “Company”) and govern your use of the websites, applications and our other offerings (collectively, the “Platform”) and related services, including relationship management, listing, scheduling, booking, billing, payment, sales analytics and marketing services (collectively, the “GG Services”).
The Platform offers an online venue that enables you (each, a “Member”, “you” or “your”, and collectively, “Members”) to access, use, browse the Platform, and to publish, offer, search for and book services. Members who publish and offer services are called “Providers” and Members who search for, book or use services are “Customers”. Providers offer activities, events and other services (collectively, the “Provider Services”, and each Provider Service offering, a “Listing”).
You must register an account to access and use many features of the Platform, and must keep your account information accurate. As the Platform provider, Go Greatest does not own, control, offer or manage any Listings or Provider Services. Go Greatest is not a party to the contracts entered into directly between Providers and Customers, nor is Go Greatest a travel agency or insurer. Go Greatest is not acting as an agent in any capacity for any Member. To learn more about Go Greatest’s role, see here.
Please read these Terms carefully, as they constitute a legally-binding agreement between each Member or Provider, as the case may be, and Go Greatest. In particular, PLEASE NOTE THESE TERMS CONTAIN AN ARBITRATION AGREEMENT AND CLASS ACTION WAIVER THAT REQUIRE YOU TO ARBITRATE ALL DISPUTES YOU HAVE WITH US ON AN INDIVIDUAL BASIS. BY ENTERING INTO THESE TERMS, YOU EXPRESSLY ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTAND ALL OF THE TERMS INCLUDED HEREIN AND HAVE TAKEN TIME TO CONSIDER THE CONSEQUENCES OF THIS IMPORTANT DECISION. If you do not agree to these Terms or any other policies, including our Privacy Policy, do not access or use Go Greatest. If you plan to use the Platform or the GG Services for any commercial purposes, i.e. if you are an independent Provider, you are responsible for understanding and complying with all laws, rules, regulations and contracts with third parties that apply to your Provider Services, including the Provider Terms of Service and the General Terms Applicable to all Members.

By using (or even just browsing) our Platform, or uploading data or information to Go Greatest, you’re agreeing to the Terms and our associated Privacy Policy. If you don’t agree with the Terms, please refrain from using our Platform.
eligibility
We only permit individuals who are at least 18 years old and can form legally binding contracts with us to use Go Greatest. If you are under 18 years old and would like to use Go Greatest, you can, but only if a parent or legal guardian who is at least 18 years old supervises you. In all cases, the adult would be the Member and is responsible for any and all activity.
By using Go Greatest, you represent and warrant that you meet all eligibility requirements outlined in these Terms. We reserve the right to refuse to let certain people access or use Go Greatest and the right to change our eligibility criteria.
You can only use Go Greatest to the extent the laws of your jurisdiction or the United States do not bar you from doing so. Please make sure these Terms are in compliance with all laws, rules, and regulations that apply to you.
Your Privacy
We know your personal information is important to you, so it’s important to us. Our Privacy Policy details how your information is used when you use our Platform, and it’s also a part of our Terms, so please carefully read it here.
Email Communication
By creating an account with Go Greatest, you automatically opt in to receive email communications regarding Go Greatest. Some of those emails may relate to bookings that you make through the Platform (each, a “Booking”). Other emails may be promotional in nature. While you cannot opt-out of transactional emails—such as order confirmations, invoices, and specific communication about your classes—if you book a Provider Service, you can opt-out of receiving our promotional emails by clicking an unsubscribe link found at the bottom of our promotional emails.
Passwords
You’re responsible for safeguarding the password that you use to access Go Greatest and for any activities or actions under your password. We encourage you to use “strong” passwords (passwords that use a combination of upper and lower case letters, numbers, and symbols) with your account. We cannot and will not be liable for any loss or damage arising from your failure to comply with the above.

Fees and Payment
By Booking a Provider Service you are responsible for paying any and all applicable fees, as indicated on Go Greatest at the time of registration. Fees may be updated from time to time, and are more fully described on Exhibit A.
Refunds
Generally, our fees are nonrefundable. We may, at our discretion, provide a refund to Customers under certain circumstances. Please email hello@gogreatest.com for consideration. If refunded, we reserve the right to charge you a fee to cover the cost of any Provider Service you may have attended prior to cancellation. Any additional discounts or refunds that we may choose to provide are in our sole discretion and do not entitle you to any future discounts or refunds for similar instances in the future.
Price Changes
We reserve the right to adjust our prices at any time. If we ever need to change our prices, we will let you know either through the Platform or email.
Payment Methods
You may change your payment information at any time by logging onto the Platform and going to the “My Account” page. If for some reason a bill is not successfully settled and you do not edit your payment method or cancel your account, you nonetheless remain responsible for any uncollected amounts, authorizing us to continue billing your payment method, as it may be updated, including if you attempt to create a new account. This may result in a change to your payment billing dates. If we cannot charge your account, we reserve the right, but are not obligated, to terminate your access to the Platform or any portion thereof.
Cancellation of Provider Services
Although we recommend never Booking a Provider Service unless you are sure you can attend, we know that sometimes things come up. Each Provider Service is subject to the cancellation policy of the respective Provider, and specific cancellation policies can be found under each respective Provider Service’s details which can be found under your Go Greatest ‘My Account’ page after your registration for the respective Provider Service. We recommend reviewing the cancellation policy of each Provider Service and Provider before Booking any Provider Service. Any and all cancellations must be made in the manner laid out in the Provider Service description. If you do not cancel a Provider Service as required by its respective cancellation policy, and you do not attend your respective Booking (aka “no show”), we reserve the right to charge you the full amount that the Provider charges for such Provider Service and/or the applicable cancellation fees. We also reserve the right to terminate your account.
Providers and Customers are responsible for any Booking modifications they agree to make via the Platform or direct Go Greatest Member service to make on their behalf, and agree to pay any additional amounts, fees or taxes associated with a Booking modification.
Other Fees Charged by Providers
Some of our Providers may charge add-ons, equipment or other amenity fees for Provider Services that are included as part of your Booking that are not included in your Booking cost on Go Greatest. These fees will always be disclosed to you by the Provider prior to Booking. Any fees owed to the Provider that are not included in the Booking are to be paid by the Customer at the Booking.
Third Party Fees for Using Go Greatest
You are also responsible for all third-party charges and fees associated with connecting and using the Platform, including fees such as Internet service provider fees, payment processing fees, telephone and computer equipment charges, sales tax, and any other fees necessary to access the Platform.
Warranty and Limitations of Liability
You understand and agree that we have no control over, and no duty to take any action regarding:
which Providers you access via our Platform;
what Provider Services you book; or
what actions you may take as a result of your exposure to or use of Go Greatest; or
what may occur during your participation in any Provider Services booked through Go Greatest.
You release us from all liability related to your use of Go Greatest, including any liability resulting from Provider Services booked on our Platform, any content posted on your Go Greatest account, or any Providers you interact with. We make no representations concerning any content contained in or accessed through our Platform and will not be responsible or liable for the accuracy, copyright compliance, legality, or decency of material contained in or accessed through Go Greatest by our Members.
WITHOUT LIMITING THE EFFECT OF ANY WARRANTIES, DISCLAIMERS OR LIMITATIONS OF LIABILITY IN THE “GENERAL TERMS APPLICABLE TO ALL MEMBERS” SECTION, IN THE EVENT THAT YOU HAVE A DISPUTE WITH A PROVIDER, YOU AGREE TO RELEASE US AND OUR OFFICERS, DIRECTORS, REPRESENTATIVES, AGENTS, SERVANTS, COUNSEL, EMPLOYEES, CONSULTANTS, AND OTHER PERSONNEL AUTHORIZED TO ACT, ACTING, OR PURPORTING TO ACT ON OUR BEHALF (COLLECTIVELY, THE “GO GREATEST PARTIES”) FROM ANY AND ALL CLAIMS, DEMANDS, OR DAMAGES (ACTUAL OR CONSEQUENTIAL) OF EVERY KIND AND NATURE, KNOWN AND UNKNOWN, SUSPECTED AND UNSUSPECTED, DISCLOSED AND UNDISCLOSED, ARISING OUT OF OR IN ANY WAY CONNECTED WITH SUCH DISPUTES. WE EXPRESSLY DISCLAIM ANY LIABILITY THAT MAY ARISE BETWEEN YOU AND PROVIDER.
WE EXPLICITLY DISCLAIM ALL LIABILITY FOR ANY ACT OR OMISSION OF ANY PROVIDER OR OTHER THIRD PARTY. WE ARE NOT AN AGENT OF ANY PROVIDER OR OTHER THIRD PARTY. AS WITH THE PURCHASE OF A PRODUCT OR SERVICE THROUGH ANY MEDIUM OR IN ANY ENVIRONMENT, YOU SHOULD USE YOUR BEST JUDGMENT AND EXERCISE CAUTION WHERE APPROPRIATE.
SOME STATES DO NOT ALLOW THE DISCLAIMER OF IMPLIED WARRANTIES, SO THE FOREGOING DISCLAIMERS MAY NOT APPLY TO YOU. THIS PARAGRAPH GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER LEGAL RIGHTS THAT VARY FROM STATE TO STATE.
Indemnification and Release
You understand that we are not a Provider and any services listed on the Platform are operated and delivered by the respective Providers. Although we hope Providers only offer the highest quality services, we are not responsible for the quality, substance, or performance of any of the activities listed on the platform. You understand that there are certain inherent risks and dangers in attending or participating in the Provider Services listed on the Platform. By signing up for a Go Greatest account and Booking a Provider Service, you acknowledge and agree, on behalf of yourself, your heirs, personal representatives and/or assigns that you are aware of these risks which include, but are not limited to, property damage, illness, and bodily injury or death.
You acknowledge that some of these risks cannot be eliminated and you specifically assume the risk of injury or harm to you or your child. You acknowledge and agree that it is your responsibility to consult with your child’s primary care physician prior to participating in a service and to determine whether a Provider Service is appropriate for your family and your child. You also understand and agree that Go Greatest may offer child-related information that is designed for informational and entertainment purposes only. The use of any of the information provided on Go Greatest is solely at your own risk.

Provider Obligations.
Contracting with Customers. When you accept a Booking request, or receive a Booking confirmation through the Platform, you are entering into a contract directly with the Customer, and are responsible for delivering the Provider Services under the terms and at the price specified in your Listing. You are also agreeing to pay applicable Fees and Taxes (each as defined below) for each Booking. Go Greatest will deduct amounts you owe from your payout unless we and you agree to a different method. Any terms or conditions that you include in any supplement contract with Customer must: (i) be consistent with these Terms, Privacy Policy and the information that you provided in your Listing; and (ii) be prominently disclosed in your Listing description.
Service Level Standards. Provider agrees to adhere to the standards set forth in Go Greatest’s Service Level Standards, as it may be updated or modified from time to time. A copy of the current Service Level Standards in effect is attached as Exhibit B.
Use of Go Greatest Platform. Provider agrees to use the systems provided by Go Greatest to manage Bookings that Provider receives using the Platform. The Platform provides tools that make it easy for you to set up and manage a Listing. Your Listing must include complete and accurate information about your Provider Services, your fees and charges and any rules or requirements that apply to your Customer or Listing. You are responsible for keeping your Listing information (including calendar availability) and content (like photos) up-to-date and accurate at all times. We recommend that you obtain appropriate insurance for your Provider Services.
Equipment. You are responsible for providing all equipment, including supplies, vehicles, venues and other materials (“Equipment”) necessary to provide your Provider Services. You are solely responsible for ensuring that the Equipment used in your Provider Services is in good working order and conforms to all laws pertaining to safety, equipment, inspection, and operational capability. Except as otherwise required by law, you assume all risk of damage or loss to your Equipment.
You are Responsible for Your Own Acts and Omissions. You are responsible and liable for your own acts and omissions and are also responsible for the acts and omissions of anyone you allow to participate in providing your Provider Services. You are responsible for setting your price and establishing rules and requirements for your Listing. You must describe any and all fees and charges in your Listing description and may not collect any additional fees or charges outside the Platform except those expressly authorized by Go Greatest in writing. Do not encourage Customer to create third-party accounts, submit reviews, provide their contact information, or take other actions outside the Platform in violation of our Non-Circumvention obligations.
Compliance with Laws and other Obligations. You are responsible for (i) understanding and complying with all laws, rules and regulations, including data privacy laws, that may apply to your Provider Services, (ii) obtaining any required licenses, permits, or registrations prior to providing your Provider Services; and (iii) ensuring that your Listing and/or providing of Provider Services will not breach any agreement you may have with any third party. You should only use personal information you receive through the Platform as necessary to manage your reservations, comply with applicable laws, and deliver your Provider Services.
Your Assumption of Risk. You acknowledge that providing your Provider Services carries inherent risks and agree that you assume the entire risk arising out of your access to and use of the Platform, offering Provider Services, or any interaction you have with other persons through the use of the Platform or provision of the Provider Services, whether in person or online. You agree that you have had the opportunity to investigate the Platform and any laws, rules, regulations, or obligations that may be applicable to your Listings or Provider Services and that you are not relying upon any statement of law made by Go Greatest.
Independence of Providers. Your relationship with Go Greatest is that of an independent individual or entity and not an employee, agent, joint venturer, or partner of Go Greatest. Go Greatest does not direct or control your Provider Services, and you agree that you have complete discretion whether and when to provide Provider Services, and at what price and on what terms to offer them.
Payments Through the Go Greatest Platform. Provider agrees to use the payment software on the Go Greatest Platform for all Provider Services that it provides to Customers received through the Go Greatest Platform. All such transactions are subject to the payment processor’s terms and conditions.
Providing Services as a Team or Organization. If you work with a co-Provider or provide Provider Services as part of a team, Provider, or other organization, the entity and each individual who participates in providing Provider Services is responsible and liable as a Provider under this Agreement. If you accept terms or enter into contracts, you represent and warrant that you are authorized to enter into contracts for and bind your team, Provider or other organization, and that each entity you use is in good standing under the laws of the place where it is established. If you perform other functions, you represent and warrant that you are authorized to perform those functions. If you instruct Go Greatest to transfer a portion of your payout to someone else, you must be authorized to do so, and are responsible and liable for the payment amounts and accuracy of any payout information you provide.
Feedback & Reviews. Provider agrees to participate in any review or feedback processes requested by Go Greatest. Provider acknowledges and consents to Go Greatest contacting Customers engaged by Provider through the Platform for review and feedback purposes.
- search ranking.
You acknowledge and agree that the ranking of Listings in search results on the Platform depends on a variety of factors, including these main parameters:
“Featured” characterization (e.g. Listings relating to a paid monthly subscription with Go Greatest will receive more prominent ranking),
Member search parameters (e.g. number of Members, time and duration of the requested Provider Services, price range),
Listing characteristics (e.g. price, calendar availability, number and quality of images, Provider reviews, type of Provider Service, Provider status, age and/or viewership of the Listing, average Customer popularity),
Provider requirements (e.g. minimum or maximum nights, Booking cut-off time), and
Member preferences (e.g. previous trips, saved Listings, location from where the Member is searching).
Go Greatest may allow Providers to promote their Listings in search or elsewhere on the Platform by paying an additional fee.

Go Greatest may charge Fees and applicable Taxes to Providers for the right to use the Platform. More information about when Fees apply and how they are calculated can be found on Exhibit A. Except as otherwise provided on the Platform, Fees are non-refundable. Go Greatest reserves the right to change the Fees at any time, and will provide Providers notice of any Fee changes before they become effective. Fee changes will not affect Bookings made prior to the effective date of the Fee change. If you disagree with a fee change you may terminate this Agreement at any time pursuant to Section 6 of Article II and Section 10 of Article III.

Taxes.
As a Provider, you are responsible for determining and fulfilling your obligations under applicable laws to report, collect, remit, or include in your price any applicable indirect taxes, occupancy taxes, tourist, income, or other taxes (“Taxes”). In certain jurisdictions, Tax regulations may require that we collect and/or report Tax information about you, or withhold Taxes from payouts to you, or both. If you fail to provide us with documentation that we determine to be sufficient to support any such obligation to withhold Taxes from payouts to you, we may withhold payouts up to the amount as required by law, until sufficient documentation is provided. You agree that Go Greatest may issue on your behalf invoices or similar documentation for VAT, GST, consumption or other Taxes for your Provider Services to facilitate accurate tax reporting by you, our Customers, and/or their organizations.

Cancellations and Booking Modifications.

In general, if a Customer cancels a Booking, the amount paid to you is determined by the cancellation policy that applies to that Booking. As a Provider, you should not cancel on a Customer without a Valid Reason or applicable law. As used herein, “Valid Reason” means a situation that occurs after Booking, are unforeseen at the time of Booking, and prevent or legally prohibit completion of the Booking, such as natural disasters and military actions.

We will waive Cancellation Fees (defined below) in the event of cancellation for a Valid Reason. In the event a fee is waived, other consequences may still apply, like blocking a Listing’s calendar.

Providers who believe one of the Valid Reason situations applies will be required to provide documentation or other support. We will determine whether to waive any fees and other consequences after evaluating the evidence.

A Provider must promptly cancel a Booking that the Provider cannot honor and may not encourage the Customer to cancel the reservation.

If you cancel on a Customer without such a Valid Reason, we may impose a cancellation fee (“Cancellation Fee”) based on the Booking amount and when the Booking is canceled, in such amounts as follows:

If the Booking is canceled 48 hours or less before the start time, or after the start time, the fee is 50% of the Booking amount;
-
If the Booking is canceled more than 48 hours, and 30 days or less, before start time, the fee is 25% of the Booking amount; and
-
If the Booking is canceled more than 30 days before the start time, the fee is 10% of the Booking amount.
If the calculated Cancellation Fee is less than $50 USD, it will be adjusted up to $50 USD, and if the calculated Cancellation Fee is more than $1,000 USD, it will be adjusted down to $1,000 USD.
Cancellation Fees are typically withheld from the next payout(s) to the Provider.

If: (i) a Customer experiences a Service Issue (as defined below), (ii) a Valid Reason arises, or (iii) a Booking is cancelled by the Customer, the amount you are paid will be reduced by the amount we refund or otherwise provide to the Customer, and by any other reasonable costs we incur as a result of the cancellation. If a Customer receives a refund after you have already been paid, or the amount of the refund and other costs incurred by Go Greatest exceeds your payout, Go Greatest may recover that amount from you, including by offsetting the refund against your future payouts. You agree that this Agreement preempts the cancellation policy you set in situations where they allow for the cancellation of a Booking and/or the issuance of refunds to Customer. If we reasonably expect to provide a refund to a Customer under one of these policies, we may delay release of any payout for that Booking until a refund decision is made. As used herein, “Service Issue” means: (1) a Provider cancels prior to the Booking start time, (2) the Provider fails to provide the Provider Services, (3) the Listing contains a material inaccuracy.

Providers and Customers are responsible for any Booking modifications they agree to make via the Platform or direct Go Greatest Customer service to make on their behalf, and agree to pay any additional amounts, fees or taxes associated with a Booking modification.

Termination of this Agreement.
Either Provider or Company may terminate this Agreement upon giving the other party thirty (30) days prior written notice of such termination. Go Greatest may terminate this Agreement immediately and without prior notice if Provider breaches this Agreement, including by failing to use the Platform for billing as specified by Go Greatest or conforming with any terms of the Service Level Standards set forth in Exhibit B, as they may be updated from time to time.

Non-Circumvention and Other Requirements.

Provider shall not:

Engage in any tactics, or direct or encourage others to engage in any tactics that attempt to circumvent the GG Services, the Go Greatest marketplace or the Go Greatest Platform to book events or make reservations outside of the GG Services, the Go Greatest marketplace or Go Greatest Platform, including any tactics that are designed to avoid paying required fees to Go Greatest.

Solicit an online or offline payment from Customers in violation of Go Greatest’s payment policy.

Interfere with the Booking of another Provider on the Platform.
-
Discourage and/or prevent Customers or potential Customers from Booking your Provider Services through the Platform.
-
“Farm” out Customer leads (i.e., taking Customer leads provided to you and transferring these client leads to non-Go Greatest vendors and entities or outside the Platform in any way).

Utilize Customer leads sent to other Go Greatest Providers but not to you.
-
Take people off of the Platform for new, partial, or future Bookings.
-
Contact potential Customers prior to Booking on the Platform to move the booking off of the Platform (ex: offering discounts to book off of Go Greatest)

Ask Customers or potential Customers to fill out forms, or call, email, or otherwise contact you via a non-Go Greatest communications service prior to accepting Booking requests.

Cancel existing full or partial reservations and having Customers rebook off of the Platform.
-
Ask or encouraging Customers to book outside of Go Greatest for repeat or future Bookings.
-
Ask Members for, or using, contact or identity information in ways unrelated to their purchase of Provider Services.

Sell, share or use Member contact information for marketing communications or signing Members up for contact lists.

Taking people off of the Go Greatest Platform for feedback and reviews.
You may not ask Members to review your Provider Services provided hereunder on a non-Go Greatest website or fill out a survey regarding your Provider Services hereunder on a non-Go Greatest website. These actions take valuable input about a Member’s experience away from the Go Greatest community. We want Members to share their feedback directly on the Platform so that other Members may benefit from their insights.

Provider shall not require Members to use other websites or apps to physically access a Listing, including asking Members to:

create a separate account or register on another website besides Go Greatest.com for purposes of gaining entry to a Listing; or
-
install a third-party app to access a listing; all listings on the Platform should be accessible to a Member without requiring that they have another app or account.

Listing page requirements. The Listing must be clear, complete, and accurate. Members should know exactly what to expect upon Booking the Provider Services. This applies to all Provider Services details, including:

What Customers will be doing;
-
Meeting address and instructions for meeting up with the Provider;
-
What’s included in the price (ex: what the Provider is providing for Members);
-
What Members need to bring with them (ex: extra cash to buy food that’s not included); and
-
The time and date of the delivery or provision of Provider Services.

What we don’t allow.

Mistreatment of animals.
-
Intellectual property violations. We do not permit the use of copyrighted work such as music, videos, photography, or literature unless the work was created or properly licensed by the Provider, or is in the public domain. We also prohibit the unauthorized use of other types of intellectual property such as trademarks (ex: brand names) or individual names (ex: celebrities) that suggest an endorsement of, or affiliation with, a Provider or Experience.

Violation of local laws or restrictions. Providers are responsible for understanding and complying with all applicable laws, rules, regulations, and other requirements that apply to their Provider Services.

Client Complaints; Disputes with Other Providers.

Provider shall fully cooperate with Go Greatest in investigating and resolving any inquiries or complaints concerning the provision of any Provider Services to a Member, in accordance with any Go Greatest inquiry and dispute resolution processes then in effect. Provider further agrees to promptly respond to all communications from Go Greatest concerning any inquiry or complaint, and in no event later than one (1) business day from receipt of such communication.

General Terms Applicable to all Members

Third-party Services and Content
We utilize links and other tools to connect Members, Customers and Providers to third party services and websites, such as businesses, advertisers, special offers, or other events or services that are not owned or controlled by Go Greatest (individually a “Third Party Service,” collectively the “Third Party Services”). We have no control over the content and policies of these Third Party Services, and in no event shall we be held responsible or liable for the accuracy, reliability, or currentness of any third party’s content or policies.
Members who access or use Third Party Services through Go Greatest are solely responsible for complying with the terms and policies of these third parties.
In no event shall a description or reference to a third party’s product or service (including, but not limited to, providing a description or reference via hyperlink) be construed as an endorsement of such third party products or services by us. We retain the exclusive right to add to, modify, or cancel the availability of any Third Party Service.

Creating an Account
You must register an account to access and use many features of the Platform. Registration is only permitted for legal entities, partnerships and natural persons who are 18 years or older. You represent and warrant that you are not a person or entity barred from using the Platform under the laws of the United States, your place of residence, or any other applicable jurisdiction. You must provide accurate, current, and complete information during registration and keep your account information up-to-date. You may not register more than one account or transfer your account to someone else. You are responsible for maintaining the confidentiality and security of your account credentials and may not disclose your credentials to any third party. You are responsible and liable for activities conducted through your account and must immediately notify Go Greatest if you suspect that your credentials have been lost, stolen, or your account is otherwise compromised. If and as permitted by applicable law, we may, but have no obligation to (i) ask you to provide identification or other information, (ii) undertake checks designed to help verify your identity or background, (iii) screen you against third-party databases or other sources and request reports from service providers, and (iv) obtain reports from public records of criminal convictions or sex offender registrations or their local equivalents.
Go Greatest powers Providers with registration, Booking, check-out, and payments systems. To create an account, Members must provide Go Greatest with his, her or its email address, home or billing address, phone number and username. In addition, to book a Provider Service, Customers must add his, her or their child’s name, birthdate, address, and credit card information, as well as other information requested by the Providers. To book a Provider Service, Customers will be providing their account information to the Providers’ contacts as well as to Go Greatest. This information is stored in the Go Greatest database. If you use the same account to make a booking at another Provider within the Go Greatest ecosystem, all information may be accessible to the current Listing Provider (except your credit card information).
By creating an account, you’re agreeing to a few rules and acknowledgements:

Be honest with us. By creating an account, you’re agreeing to provide accurate and complete information about yourself. It’s not OK to use false information or impersonate another person or company through your account.

Be respectful. We’re trying to build a supportive community. Therefore, we ask that you respect others in the community. This will allow our community to continue to flourish. If we find out that you are negatively impacting the experience of fellow Go Greatest Members, we reserve the right to terminate your account.

You’re responsible for your account. You’re solely responsible for any activity on your account. Your accounts are not transferable. If you’re sharing an account with other people, the person whose email information is on the account will ultimately be responsible for all activity.

Protected Materials
The Go Greatest Platform contains copyrighted material, trademarks, and other similar proprietary information provided by or through us, our employees, agents, licensors, or other Go Greatest Parties (defined below) (collectively, “Proprietary Information”). Our Proprietary Information is protected by copyright law, registered and unregistered trademarks, database rights, and other intellectual property rights. Unless otherwise provided, we exclusively own all Proprietary Information and your use of Go Greatest does not grant you any right, title, or interest in the Platform.
You agree to use any such Proprietary Information only in the form and manner and with appropriate legends or disclaimers prescribed by Go Greatest. Your use of Proprietary Information must be approved, in writing, by Go Greatest.
All use of Go Greatest Proprietary Information shall inure to the benefit of Go Greatest. At no time during or after the term of this agreement shall Provider challenge or assist others to challenge any Proprietary Information owned by Go Greatest, its affiliates, or assigns, or the registration thereof or attempt to register any service marks, trademarks, or trade names confusingly similar to those of Go Greatest, its affiliates or assigns.

Your Use of Go Greatest
Subject to your strict compliance with these Terms, we grant you a limited, personal, non-exclusive, revocable, non-assignable and non-transferable right and license to use the Go Greatest Platform to view, List or Book a Service.
The above license is conditional upon your strict compliance with these Terms at any and all times during your use of Go Greatest and the commonsense ground rules outlined below.

Don’t Use Go Greatest to Break the Law
You agree that you will not violate any laws when using Go Greatest. This includes any local, provincial, state, federal, national, and international laws that may apply to you. Don’t commit fraud, theft, or any other crimes against Go Greatest, a Provider, or any third-party.

Don’t Steal From Us
You agree not to “crawl,” “scrape,” or “spider” Go Greatest or to reverse engineer or attempt to obtain our source code or data.

Don’t Try to Harm Our Systems
You agree not to distribute any virus or other harmful computer code through Go Greatest, including viruses, Trojan horses, spyware, adware, malware, bots, time bombs, worms, or other harmful or malicious components, which or might overburden, impair or disrupt Go Greatest or servers or networks forming part of, or connected to, Go Greatest, or which does or might restrict or inhibit any other Member’s use and enjoyment of Go Greatest.

Don’t Alter Legal Notices
You agree not to alter or remove, or attempt to alter or remove, any trademark, copyright or other proprietary or legal notices contained in, or appearing on, the Platform or any Content (defined below) appearing on the Platform (other than your Content).

Content
Parts of the Platform enable you to provide feedback, text, photos, audio, video, information, and other content (collectively, “Content”). By providing Content, in whatever form and through whatever means, you grant Go Greatest a non-exclusive, worldwide, royalty-free, irrevocable, perpetual, sub-licensable and transferable license to copy, modify, prepare derivative works of, distribute, publish and otherwise exploit, that Content, without limitation. If Content includes personal information, our Privacy Policy describes how we use that personal information. Where Go Greatest pays for the creation of Content or facilitates its creation, Go Greatest may own that Content, in which case supplemental terms or disclosures will say that. You are solely responsible for all Content that you provide and warrant that you either own it or are authorized to grant Go Greatest the rights described in these Terms. You are responsible and liable if any of your Content violates or infringes the intellectual property or privacy rights of any third party. Content must not be discriminatory, obscene, harassing, deceptive, violent, or illegal in nature.

Termination
We may terminate or suspend your account and your access to Go Greatest at any time, for any reason, without advance notice. If we do so, it’s important to understand that you don’t have a contractual or legal right to continue to use our Platform. Go Greatest may refuse to allow anyone to use the Platform, at any time, for any reason.
If we terminate your account, you must immediately stop using Go Greatest and you agree not to attempt to regain access to our Platform without our express permission.
Such termination will result in the suspension or deletion of your account and access to your account. In the event of termination of your account, the provisions of this Agreement shall remain in effect.
If you terminate your account, or if we terminate your account, you may lose any information associated with your account, including your Content.
The obligations of each party concerning Bookings made prior to the date of termination (including regarding payment of Fees) shall survive until those matters have been fully resolved.

We May Discontinue Go Greatest
We reserve the right to change, suspend, or discontinue Go Greatest at any time, for any reason. We will not be liable to you for the effect that any changes to the Platform may have on you and you may not be able to recover any Content that you posted to Go Greatest.

Warranties
YOU UNDERSTAND AND AGREE THAT USING THE PLATFORM AND THE GG SERVICES IS AT YOUR SOLE RISK AND WE MAKE NO REPRESENTATIONS OR WARRANTIES WITH RESPECT THERETO, THE ACCURACY OR COMPLETENESS OF ANY INFORMATION OR MATERIALS PUBLISHED ON THE PLATFORM, INCLUDING ANY INFORMATION OR MATERIALS RELATED TO SERVICES OR PROVIDERS OR ANY OTHER SOFTWARE REFERENCED IN THIS AGREEMENT, ALL OF WHICH ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AVAILABILITY, ACCURACY, COMPLETENESS, SECURITY, COMPATIBILITY, RELIABILITY, OR OTHERWISE, WITH RESPECT TO ALL SUCH SOFTWARE. IF YOUR USE OF THE PLATFORM RESULTS IN THE NEED FOR SERVICING OR REPLACING EQUIPMENT OR DATA, WE ARE NOT RESPONSIBLE FOR THOSE COSTS.
THE GO GREATEST PARTIES DO NOT WARRANT THAT THE PLATFORM OR THE GG SERVICES WILL BE ERROR-FREE OR THAT DEFECTS WILL BE CORRECTED. MOREOVER, YOU EXPRESSLY AGREE THAT YOUR USE OF THE PLATFORM AND ANY THIRD-PARTY SOFTWARE ON THE PLATFORM IS AT YOUR OWN RISK. THE GO GREATEST PARTIES DO NOT WARRANT, ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR ANY PRODUCT OR SERVICE ADVERTISED OR OFFERED BY A PROVIDER OR THIRD PARTY THROUGH THE PLATFORM OR ANY HYPERLINKED SERVICES FEATURED IN ANY BANNER OR OTHER ADVERTISING, AND WE WILL NOT BE A PARTY TO OR IN ANY WAY BE RESPONSIBLE FOR MONITORING ANY TRANSACTION BETWEEN ANY MEMBER AND A PROVIDER.
NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM US WILL CREATE ANY WARRANTY NOT EXPRESSLY MADE HEREIN.
TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, ATTENDANCE AT OR PARTICIPATION IN ANY ACTIVITIES MADE AVAILABLE THROUGH THE PLATFORM IS SOLELY AT YOUR OWN RISK. IN NO EVENT SHALL THE GO GREATEST PARTIES BE LIABLE FOR ANY ACT, ERROR, OR OMISSION BY ANY PROVIDER OR OTHER THIRD PARTY, INCLUDING, WITHOUT LIMITATION, ANY ACT, ERROR, OR OMISSION WHICH ARISES OUT OF OR IS ANY WAY CONNECTED WITH THE LISTING, YOUR BOOKING, USE OF, OR PARTICIPATION IN ANY SERVICE MADE AVAILABLE THROUGH THE PLATFORM, OR THE PERFORMANCE OR NON-PERFORMANCE OF ANY PROVIDER IN CONNECTION WITH THE PLATFORM. WE ARE NOT AN AGENT OF ANY MEMBER OR OTHER THIRD PARTY.
SOME STATES DO NOT ALLOW THE DISCLAIMER OF IMPLIED WARRANTIES, SO THE FOREGOING DISCLAIMERS MAY NOT APPLY TO YOU. THIS PARAGRAPH GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER LEGAL RIGHTS THAT VARY FROM STATE TO STATE.

Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WE OR ANY OF THE GO GREATEST PARTIES BE LIABLE TO YOU FOR ANY SPECIAL, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES UNDER ANY THEORY OF LIABILITY, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE AND PRODUCT LIABILITY), OR OTHERWISE, EVEN IF GO GREATEST HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. APPLICABLE LAW MAY NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY OR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. IN SUCH CASES, OUR LIABILITY WILL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
OUR LIABILITY TO YOU IS LIMITED TO $50 OR THE AMOUNTS, IF ANY, PAID BY YOU TO US UNDER THIS AGREEMENT IN THE THREE MONTHS IMMEDIATELY PRIOR TO THE EVENT FIRST GIVING RISE TO THE CLAIM, WHICHEVER IS GREATER. THE FOREGOING LIMITATIONS WILL APPLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, REGARDLESS OF WHETHER WE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND REGARDLESS OF WHETHER ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
THESE LIMITATIONS APPLY REGARDLESS OF LEGAL THEORY, WHETHER BASED ON TORT, STRICT LIABILITY, BREACH OF CONTRACT, BREACH OF WARRANTY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
YOU SPECIFICALLY ACKNOWLEDGE THAT WE AND THE GO GREATEST PARTIES SHALL NOT BE LIABLE FOR CONTENT OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY PROVIDER OR THIRD PARTY AND THAT THE RISK OF HARM OR DAMAGE FROM THE FOREGOING RESTS ENTIRELY WITH YOU. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY.

Indemnification and Release
To the fullest extent permitted by law, you agree to release, defend, indemnify, and hold harmless the Go Greatest Parties from any and all responsibility, claims, actions, suits, procedures, costs, expenses, damages, obligations, losses, costs, debts, and liabilities arising out of or in any way related to: (i) your use of the Platform or the GG Services; (ii) in the case of Customers and Members, you or your child’s or invitee’s attendance or participation in any Provider Service made available through the Platform, including with respect to bodily injury, physical harm, illness, death or property damage; (ii) your violation of any terms of this Agreement; (iii) any infringement or misappropriation of a third party’s intellectual property rights; (iv) your violation of any law, rule or regulation, or the rights of any third party; or (v) your interaction with any Member, Customer or Provider or your participation in or use of a Provider Service, including without limitation any injuries, losses or damages (whether compensatory, direct, incidental, consequential or otherwise) of any kind arising in connection with or as a result of such interaction, participation or use, or (vi) your failure, or our failure at your direction, to accurately report, collect or remit taxes.

Choice of Law and Choice of Forum
This Agreement shall be governed by, subject to, and interpreted in accordance with the laws of the State of New Jersey, and the federal laws of the United States, without regard to conflict of laws principles. You waive any objection based on lack of personal jurisdiction, place of residence, improper venue, or forum non conveniens in any such action.

Arbitration and Waiver of Class Action
You agree to arbitrate any dispute with us arising from this Agreement or your use of the Platform or the GG Services on an individual basis in an arbitration. That means you cannot sue us in court or have a trial by jury. Any disputes will be resolved individually in a private proceeding.

Format for Arbitration. The parties agree that: (i) any arbitration will occur in New Jersey, and (ii) the arbitration will be conducted confidentially by a single arbitrator in accordance with the rules of the American Arbitration Association for arbitration of Consumer-Related Disputes, in the English language, and with limited discovery.
At your request, hearings may be conducted in person or by telephone and the arbitrator may provide for submitting and determining motions on briefs, without oral hearings. Other than the class procedures and remedies discussed below, the arbitrator has the authority to grant any remedy that would otherwise be available to a court or other tribunal.

Attorneys’ Fees. THE PREVAILING PARTY IN ANY ACTION OR PROCEEDING TO ENFORCE THESE TERMS SHALL BE ENTITLED TO COSTS AND ATTORNEYS’ FEES. THE ARBITRAL DECISION MAY BE ENFORCED IN ANY COURT.

Waiver of Class Action. WHETHER THE DISPUTE IS HEARD IN ARBITRATION OR IN COURT, THE PARTIES WILL NOT COMMENCE AGAINST THE OTHER A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE ACTION OR PROCEEDING.

Forum. If for any reason a claim proceeds in court rather than in arbitration, the parties agree that the claim will be brought exclusively in a federal court located in New Jersey. The parties expressly consent to the exclusive jurisdiction of, and waive any and all objections to venue or jurisdiction. However, either party may seek injunctive or other equitable relief to protect its intellectual property rights and any claims regarding infringement or misappropriation of its intellectual property rights in any court of competent jurisdiction.

Notice
We may provide you with notices, including those regarding changes to this Agreement. Such notices may not be received if you violate this Agreement by accessing the Platform in an unauthorized manner. You acknowledge that under this Agreement by using the Platform or the GG Services you are deemed to have received any and all notices that would have been delivered had you accessed the Platform in an authorized manner.

Notification Procedures and Changes to These Terms
We reserve the right to revise these Terms from time to time and the most current version will always be posted on our website. If a revision, in our sole discretion, is material we will notify you. We also reserve the right to determine the form and means of providing notifications to you, and you agree to receive legal notices electronically if we so choose. By continuing to access or use the Platform after revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new terms, please stop using Go Greatest.

Force Majeure
We will not be held liable for any delays, failure in performance, or interruption of service which result directly or indirectly from any cause or condition beyond our reasonable control, including, but not limited to, any delay or failure due to any act of God, act of civil or military authorities, act of terrorism, civil disturbance, war, strike, or other labor dispute, fire, interruption in telecommunications or Internet services or network provider services, failure of equipment and/or software, or other catastrophe or any other occurrence which is beyond our reasonable control and shall not affect the validity and enforceability of any remaining provisions.

Go Greatest’s Role
We offer you the right to use a Platform that enables Members to publish, offer, search for, and book Provider Services. While we work hard to ensure our Members have great experiences using Go Greatest, we do not and cannot control the conduct of Customers and Providers. You acknowledge that Go Greatest has the right, but does not have any obligation, to monitor the use of the Platform and verify information provided by our Members. For example, we may review, disable access to, remove, or edit Content to: (i) operate, secure and improve the Platform (including for fraud prevention, risk assessment, investigation and Customer support purposes); (ii) ensure Members’ compliance with these Terms; (iii) comply with applicable law or the order or requirement of a court, law enforcement or other administrative agency or governmental body; (iv) address Content that we determine is harmful or objectionable; (v) take actions set out in these Terms; and (vi) maintain and enforce any quality or eligibility criteria, including by removing Listings that don’t meet quality and eligibility criteria. Members acknowledge and agree that Go Greatest administers its Terms, including decisions about whether and how to apply them to a particular situation, at its sole discretion. Members agree to cooperate with and assist Go Greatest in good faith, and to provide Go Greatest with such information and take such actions as may be reasonably requested by Go Greatest with respect to any investigation undertaken by Go Greatest regarding the use or abuse of the Platform.

Parties Relationship
By creating an account with Go Greatest, or using our Platform, you are not creating an agency, partnership, joint venture, employment, or franchisee relationship with our Company. You further acknowledge that by Booking a Provider Service or posting a Listing, no confidential, fiduciary, contractually implied, or other relationship is created with us other than pursuant to these Terms.
The applicable Member, and not us, is responsible for delivering any purchased goods or providing any services. If you, as a Member, choose to enter into a transaction with another Member, you agree and understand that you will be required to enter into an agreement with such Member and agree to any terms or conditions which may be imposed by such Member. As a Member, you acknowledge and agree that you, and not us, will be responsible for performing the obligations of such agreements, except as otherwise expressly set forth in the Terms.

No Waiver
Our failure to exercise or delay in exercising any right, power, or privilege under this Agreement shall not operate as a waiver; nor shall any single or partial exercise of any right, power, or privilege preclude any other or further exercise thereof.

Severability
If any provision or term of this Agreement shall be determined to be invalid, void, or unenforceable under any rule, law, or regulation or any governmental agency, local, state, or federal, such provision will be changed and interpreted to accomplish the objectives of the term or provision to the greatest extent possible under any applicable law and the validity or enforceability of any other provision of this Agreement shall not be affected.

Assignment
You agree that we may assign any of our rights, and/or transfer, sub-contract, or delegate any of our obligations, under these Terms. Your agreement to these Terms is personal to you and you may not transfer or assign it to any third party.

Entire Agreement
This Agreement sets forth the entire understanding and agreement as to the subject matter hereof, and supersedes any and all prior discussions, agreements, and understandings of any kind (including, without limitation, any prior versions of this Agreement), and every nature between us. Except as provided for above, any modification to this Agreement must be in writing and must be signed by both parties.

All headings and titles in these Terms are inserted only as a matter of convenience, and in no way define, limit, extend or interpret the scope of these Terms or of any particular paragraph or section thereof.

EXHIBIT A
Fees and Payment

For Customers and Members. Customers and Members that book through Go Greatest will be charged a flat fee of $2.99 per Booking. This is to cover the operating cost of Go Greatest, inclusive of customer service, technology, and user experience.

For Providers. For Providers that choose a package option that enables online Booking, Go Greatest will charge a 10% commission on all Bookings made through the Platform, plus any applicable transaction fees, which are 3% of the total billable amount.

For all Platform Transactions. You irrevocably and expressly authorize us to debit or credit, as applicable, any monies to the account that you have identified. You agree that it is your responsibility to maintain a valid, non-expired credit card on file with us while engaging in fee-based activities on our Platform or using our GG Services. You agree that if you do not maintain a valid, non-expired card on file with us during any billing attempt, you may be subject to interest and penalties as enumerated below and we may suspend or terminate your access to any such fee-based program upon any payment default.
You irrevocably and expressly authorize us to withhold any monies and/or debit any monies from any account that you have identified for any charge backs, fees, costs, deductions, adjustments, and any other amounts owed to us. We reserve our rights to all actions and remedies in connection with any monies owed to us. You will indemnify, defend and hold us harmless for any claims, demands or causes of actions that we take toward any identified account pursuant to this Section.

Billing Policies. You are responsible for paying any and all applicable fees as set forth in any agreement entered into (i) through the Platform or the GG Services (including for Provider Services); or (ii) by clicking through to another digital property or mobile application that requires payment, and applicable taxes associated with the Services in a timely manner with a valid payment method. Unless we state in writing otherwise, all fees and charges are nonrefundable, and all fees are quoted in U.S. Dollars. All payments must be made by the methods specified within the GG Services. If you want to use a different debit or credit card, or there is a change in debit or credit card validity or expiration date, or if you believe someone has accessed the GG Services using your user name and password without your authorization, you contact hello@gogreatest.com.

Unpaid Fees. If, for any reason, any fees you owe us have not been received or in any manner realized by us (“Unpaid Fees”), you agree to pay such Unpaid Fees immediately. In addition, we may charge interest, in the amount of 2.0% per month (or the maximum amount allowed by law), on any unpaid account balance that you maintain. Any partial payments made by Members will first be applied to the most recent fees owed to us, including interest. We reserve the right to waive or reduce the amount of any Unpaid Fees, penalties, or interest at any time. You also agree to pay any attorney fees, and other costs of collection incurred by us with respect to any Unpaid Fees. You also consent and authorize us, in our sole discretion, to make appropriate reports to credit reporting agencies, financial institutions, tax agencies and law enforcement authorities, and cooperate with them in any resulting investigation or prosecution.

Correcting Mistakes in Payments to Providers, Customers and Members. We reserve the right to fix any processing errors we discover. We will correct any processing errors by debiting or crediting the payment method used for the erroneous refund or reimbursement. Members and Customers will look solely to other Members (including Providers) to resolve any payment errors made by such Member, and we will have no liability for such errors.

Payment and Third-Party Payment Processors. Purchases made through the GG Services (including for any Provider Service) may be processed through a third-party payment processor or other payment service provider (each, a “Payment Processor”). If applicable, you may be provided a notice when entering your payment information directing you to such Payment Processor’s terms of use and privacy policy. All payments are governed by the Payment Processor’s terms of use and privacy policy.

Charges on Your Account. You are responsible for all charges incurred under your account made by you or anyone who uses your account. If your payment method fails or you are past due on amounts owed, we may collect fees owed using other collection mechanisms. Your account may be deactivated without notice to you if payment is past due, regardless of the dollar amount. You are also responsible for paying any taxes imposed on your use of the GG Services or any services contained therein (including for any Provider Services), including, but not limited to, sales, use or value-added taxes. To the extent we are obligated to collect such taxes, the applicable tax will be added to your billing account.

Authorization; Payment Processing. You expressly authorize us to debit or credit any monies from the payment method you have chosen. Authorization to charge your chosen payment method account will remain in effect until you cancel or modify your preferences within the GG Services; provided, however, that such notice will not affect charges submitted before we could reasonably act. The Provider shall be responsible for all fees associated with the processing of the payment method, including payment processing and associated bank fees.

Service Level Standards
Provider shall abide by the following requirements for using the Go Greatest Platform and to provide the following levels of service to Members.

Operational Requirements; Ethical Responsibilities. Adhere to the following minimum standards concerning its operations:

Maintaining professional liability insurance coverage with limits of not less than $100,000 per incident and $300,000 aggregate per year.

Only taking matters that Provider is competent and presently able to handle.

Responsiveness. Provider acknowledges and agrees that responsiveness is vital to the maintenance and growth of a strong network and agrees to promptly respond to Booking requests and communications from other Go Greatest Providers, Members and Customers. Provider agrees to promptly respond to Customers and Members within one (1) business day in response to any messages, emails, or phone calls. Failure to comply with this provision is grounds for the immediate termination of your account.

Candor. Treat each Member with courtesy, dignity and respect.

Timeliness. Be on time for any scheduled event, consultation or other Booking-related appointment.

Potential Issues. Immediately notify Go Greatest of any potential Member issues, disputes (including fee disputes) or complaints with any Booking or Listing.
